SUSIE STANDARD CONTEST/COMPETITION RULES FOR SPIN & WIN BARREL
These contest rules apply to all of WIN Television NSW PTY LTD (“WIN”) Susie program contests, conducted both on and off air. They may be amended or varied from time to time by WIN. Special rules may apply to particular contests, in which case WIN Television submit an application for changes to the terms and conditions to be approved by the State or Territory body. Please enquire at WIN reception or this website, www.wintv.com.au/susie for any special rules for contests you wish to enter.
1. Instructions on how to enter and prizes form part of these Conditions of Entry.
2.The promotion is open to all residents in the WIN viewing network over the age of 18 in Australia. Employees and immediate families of WIN Network Australia Pty Ltd and associated agencies are not eligible to enter.
3. This is a multiple draw promotion and commences no sooner than Monday February 18th 2008 at 00.01am EST and closes no later than Wednesday 26th November 2008 at 23.59pm EST.
4. Participants may enter the promotion by watching the Susie program on WIN and following the instructions given by the host and then mailing a postcard with their name and address written on the back with a 50 cent stamp to “SPIN & WIN” WIN Television, Locked Bag 8800, Wollongong NSW 2500. (advertised on TV on the Susie program).
5. A person is ineligible to enter and/or win a contest if:
a. They are an employee or a member of the immediate family of an employee of WIN / any related company / or their advertising agencies / or a sponsor of or associated with the contest.
b. They have previously won a prize/prizes individually or collectively from WIN as part of the same contest.
c. They are discovered to have used or attempted to use any more than one name in order to qualify to win prizes from WIN.
6. All prizes, unless otherwise specified will be dispatched from WIN to the winners within 28 DAYS of winning. WIN will make every attempt to ensure delivery of the prize within the 28 day period. All prizes dispatched will be trackable through Australia Post. In cases where prizes are returned to WIN and where the winner is subsequently not able to be contacted during the period, the prizes will be treated as forfeited and will be dealt with in accordance with the requirements of the Office of Gaming Regulation. Winners’ names and details will be posted on the Susie website for 7 days following the “on air” draw date.
7. All contestants acknowledge that WIN can rely on Rule 2 and even if WIN only learns of a person's ineligibility after WIN has appeared to award the prize to the ineligible person. Return of the prize or payment of its value to WIN can be required by WIN if this occurs.
7. This promotion is one of a game of chance. All correct entries will form part of that random draw.
8. There is 1 prize awarded to the first (1) randomly drawn eligible entrant per draw, which equates to a total of 41 draws taking place between 20/02/2008 and 26/11/2008.
9. In case of a dispute over the random draw, WIN's decision is final and no correspondence will be entered in to.
10. In the event that two winners are drawn simultaneously, WIN has the right to disqualify both entries and take the next single entry drawn. WIN reserves the right not to award a prize in a "double-draw" situation.
11. All unclaimed prizes will be redrawn three (3) months after the promotion closing date of 26/11/2007. This redraw will take place on 27/02/2008 at WIN Television, Television Ave, Mt St Thomas NSW 2500.
12. Each prize will be valued at no more than $399.00 with the total of all prizes valued at no more than $5,000. Prizes will be clothing, books, accessories or appliances. There will be no prizes containing alcohol given away in any draw of this promotion.
13. A copy of these General Contest Rules must be signed and endorsed by any winner upon request by WIN.
14. All prizes are used/taken entirely at the risk of the winner in all things, and WIN excludes all warranties in connection with any prize to the extent permitted by law.
15. WIN, its agencies, affiliates, sponsors and representatives are not liable for any loss arising out of or in connection with or resulting from any contest promoted by WIN.
16. Contest entries and material submitted in connection with any contest (whether in writing, audio or visual form, or a combination of those) becomes the property of WIN who may use the material. Copyright in any such material is assigned to WIN.
17. All prizes are non-transferable and may not be redeemed for cash.
18. Winners understand and agree that they are liable for any tax or taxes incurred on prizes awarded or received.
19. In relation to prizes involving participation in any activity:
a. WIN and its employees and agents will be fully released from and indemnified by the winner in respect of any claim for any accident, injury, property damage or loss of life in connection with winner's participation in the prize.
b. The winner may, at the option of WIN, be required to sign a form of indemnity required by WIN as a pre-condition of entitlement to the prize; and
c. If a winner is under the age of 18, their parent/guardian will need to sign the indemnity and consent to the winner's participation in the prize.
20. If the specified prize becomes unavailable due to unforeseen circumstances, the WIN may substitute a prize of like or equal value.
21. A winner must make him or herself available for a photo session if required and acknowledges that WIN has the right to use the publicity photos/film/videos, in any reasonable manner it sees fit.
22. WIN may publicise, broadcast or otherwise disclose a winner's name or any recording of the winner's voice in advertising or promotion concerning winning of the contest, or WIN contests generally.
23. WIN may incorporate information from entrants in any contest(s) in any database for use for the purpose of its business.
24. Any failure by WIN to enforce any of these rules in any instance(s) will not give rise to any claim by any other person.
